Applying IP Rights to Big Data

Professor Daniel Gervais, Director of the Intellectual Property Programme at Vanderbilt Law School, has recently published an in-depth article reviewing the application of IP rights (copyright, patent, sui generis database right, data exclusivity and trade secret) to Big Data.

Daniel Gervais used to work as legal officer for the World Trade Organization (WTO) and is the former head of the Copyright Projects section of the WIPO.

The article states that IP rights may need to be adapted in order to be ideally applied to Big Data cases. However, according to Gervais, courts and legislators will have to deal with years of questions dealing with the constraints in and the protection of Big Data.
